We Explain Before You Decide
We’ll explain how Chapter 7 and Chapter 13 work, what each may accomplish, and the important limitations you should understand before deciding whether bankruptcy is right for you.
Our Hoover bankruptcy team helps clients facing overdue mortgage or vehicle payments, wage garnishment, lawsuits, credit-card debt, medical bills, and other financial pressures.
A House Payment That Has Slipped
Chapter 13 may sometimes allow eligible homeowners to address mortgage arrears over time while continuing ongoing payments. It is not a guarantee that the house stays. Facts and timing control.
Bankruptcy can affect repossession activity. Chapter 13 may help with missed vehicle payments in some situations. An already repossessed vehicle is a narrower problem.
The automatic stay generally pauses many wage garnishments after a case is filed, while the stay remains in effect. Exceptions and prior cases can change that.
Most collection lawsuits pause while the automatic stay remains effective. Some proceedings are excepted. A judgment already entered still has to be classified.
You do not need a crisis letter to justify a consultation. If the household math no longer works, Hoover is a place to ask what the chapters may change.
Chapter 7 can discharge many types of qualifying unsecured debt. Eligibility rules apply, Alabama exemptions affect how property is treated, and some debts cannot be discharged.
Unsecured debt is the main issue
Chapter 7 eligibility needs to be checked, not assumed
Property needs an Alabama exemption analysis
Non-dischargeable debts should be identified early
Chapter 13 for Hoover Households Trying to Catch Up
Chapter 13 is a court-supervised repayment process of generally three to five years. Payments go to a Chapter 13 trustee. It is not a consumer debt-consolidation product, and unsecured creditors are not promised payment in full.
Over-the-mountain clients often ask about it because of a house or a car, or because Chapter 7 would not fit the income or equity picture.
Eligible mortgage or vehicle arrears may be addressed in the plan
Ongoing payments still have to be realistic
Unsecured creditors receive what the confirmed plan requires
The court has to confirm the plan before it binds anyone
Same Federal Chapters. Different Place to Ask the Question.
Hoover and Birmingham use the same Chapter 7 and Chapter 13 rules. The comparison below is the high-level difference. Your file still has to be run through the actual numbers.

Generally 3–5 years
Chapter 13 trustee plan payment
Generally no Chapter 13-style repayment plan
Plan payments to a Chapter 13 trustee
Dealing with arrears
Generally does not provide a multi-year catch-up plan
May help address eligible mortgage or vehicle arrears
Property considerations
Alabama exemptions and liens require a case-specific analysis
Often discussed when keeping certain property is an important goal
Eligibility
Chapter 7 rules, including applicable means-test considerations
Chapter 13 eligibility and plan requirements apply
There is no universally better chapter. The right option depends on the person’s debts, income, property, and goals.
You do not need to know whether Chapter 7 or Chapter 13 is right for you before you call. We’ll start with what is causing the financial pressure, review your debts, income, property, and goals, and explain the options that may be available. The consultation does not obligate you to file.

Bankruptcy can stop lawsuits, foreclosures, repossessions, and wage garnishments. Whether and how those protections apply in your situation can depend on timing, prior bankruptcy filings, and other facts. Our bankruptcy team can review what is happening now and explain what filing may change.
Shelby County, Jefferson County, and the Southern Division
Federal law governs the case. Alabama exemptions still matter because Alabama opted out of the ordinary federal bankruptcy exemption list.
Hoover sits in Shelby County and borders Jefferson County. Both counties are in the Northern District of Alabama’s Southern Division, whose office is in Birmingham. Venue follows the debtor’s residence or domicile. Meeting in Hoover does not move a case into a different court. See Alabama bankruptcy courts.
The directory listing is limited to attorneys who currently practice bankruptcy and serve the Hoover office. An attorney may represent Hoover clients without sitting in Suite 400 full time.

Hello Hoover Community! I wanted to share a difficult life decision with my financial affairs. I have been in a terrible struggle since my divorce in 2012 with anything to do with money. Doing extra for my kids past the child support, cars, car fixes, house maintenance and NOT even a vacation!
I am 62 and tired. I sought how the bankruptcy process would work for me after talking to at least 6 “debit consolidation” companies where you pay them so much a month and when you have money in their account they start to pay creditors 50 cents on the dollar. The problem is “legal protection”. They don’t guarantee or offer it for an individual.
Bankruptcy for some reason is a bad term in financial woes and trying to get future loans. I found Brock and Stout and they have been WONDERFUL! Actually Google A.I. said they were the best in my area of Hoover with a 5.0 so I called them.
A.I. was correct! I schedule an appointment for their remote location and met Destini. She was awesome. I am retired Military so I had all the proper paperwork desired to get a quick start as some of my monthly payments were getting behind. Than the lawyer and Julie. A fantastic team and process which only took 6 working days. I did have all the paperwork which helped 100% with that timeline.
Today is 8 Oct 2026 and at this moment I don’t have any “STRESS”, “Anxiety” which I have carried since 2012. It’s beautiful!
I was advised for Chapter 13 and I still keep my house. I can afford the monthly payments and still live with confidence. If you are reading this and are in financial stress call Brock and Stout Hoover/Bham locations and get started for stress relief. I have a 5 year payment plan.
The debit consolidation stuff you see on social media is ALL A SCAM! They end up taking 20-30 percent of your money and NO LEGAL PROTECTION! Call Brock and Stout today with ALL your financial challenges and if your monthly payments are piling up behind! 100%. Salute!!

I was feeling completely overwhelmed with all of the mounting debt that I found myself in. Brock and Stout made filing my Chapter 13 case an easy and stress free process. I felt the pressure was taken off of me from the moment that I called, scheduled my appointment and stepped into their office. Madisun was very caring and professional. She made me feel like I was in good hands from start to finish. It was a fast smooth, stress free process. I would highly recommend Brock and Stout.

They are very helpful. I made the biggest mistake by using national debt relief trying not to file but then I realized how bad they are. I finally call Brock and sprout and they helped me finally get closure. I would recommend them anytime. They saved me from a horrible situation that I felt lost in.
