Brock & Stout has filed more than 40,000 bankruptcy cases firmwide, giving our team experience with a wide range of financial situations.
We Explain Before You Decide
We will look at debts, income, and property, then tell you whether Chapter 7 or Chapter 13 may help. The decision to file stays with you.
People contact our Mobile bankruptcy team for many reasons, including wage garnishment, lawsuits, overdue mortgage or vehicle payments, medical bills, credit-card debt, and other financial pressures.
Lawsuits and Collection Activity
The automatic stay generally pauses most collection lawsuits and collection activity while it remains in effect. Exceptions exist. A judgment already entered still has to be classified.
Filing generally triggers the automatic stay and can pause many wage garnishments while the stay remains effective. Prior cases and statutory exceptions can change that.
Chapter 13 may sometimes help eligible homeowners address mortgage arrears over time while ongoing payments continue. We do not promise that every home can be saved.
Bankruptcy can affect repossession activity. Chapter 13 may help with missed vehicle payments in some cases. An already repossessed vehicle is a timing problem.
You do not need a crisis on the courthouse steps. If the monthly picture does not work, a downtown consultation can tell you whether filing belongs in the conversation.
Chapter 7 can discharge qualifying debts. Many common unsecured debts may be dischargeable. Not every debt is. Eligibility rules apply.
Alabama exemptions affect the property analysis. Liens are not automatically removed. Filing downtown does not create a different set of federal rules.
Chapter 13 When Mobile Clients Need a Court-Supervised Plan
Chapter 13 is a court-supervised repayment process, generally three to five years, with payments to a Chapter 13 trustee. Unsecured creditors are not necessarily paid in full.
It is often discussed when someone is behind on a house or car, or when Chapter 7 is not the better fit because of income or property.
Eligible arrears may be addressed through the plan
Ongoing payments still have to be feasible
The confirmed plan sets what unsecured creditors receive
You do not need to know whether Chapter 7 or Chapter 13 is right for you before you call. We’ll start with what is causing the financial pressure, review your debts, income, property, and goals, and explain the options that may be available. The consultation does not obligate you to file.
Tell Us What Is Happening
Tell us about the debts or collection problems that are causing concern, including any garnishment, lawsuit, foreclosure, repossession, or missed payments.
We Review Your Financial Picture
We’ll look at your income, debts, property, and other information that may affect your bankruptcy options.
We Explain Your Options
We’ll explain how Chapter 7 and Chapter 13 may apply to your situation, including important benefits and limitations.
You Decide What Comes Next
If you decide to move forward with Brock & Stout, we’ll explain the next documents and steps. If you need time to consider your options, that decision remains yours.
Bankruptcy can stop lawsuits, foreclosures, repossessions, and wage garnishments. Whether and how those protections apply in your situation can depend on timing, prior bankruptcy filings, and other facts. Our bankruptcy team can review what is happening now and explain what filing may change.
Mobile County and the Southern District of Alabama
Bankruptcy is primarily federal law. Alabama exemptions still matter because Alabama uses its own exemption scheme instead of the ordinary federal list.
Mobile County is in the Southern District of Alabama. The clerk’s office and main courthouse are in Mobile. Venue follows the debtor’s residence or domicile, not which office you contacted. Baldwin County clients may use the Foley office for convenience and still file in the Southern District. See Alabama bankruptcy courts.
